Taylor Swift Can’t Sue Kanye West for Recording Their Conversation, and Here’s Why

It looks like Taylor Swift won’t be seeing Kanye West in court anytime soon, even if she wanted to.
After Kim Kardashian leaked damning footage on Sunday night (July 17) of the two superstars having a phone conversation and seemingly agreeing to the controversial “Famous” lyrics, which led to a Twitter free-for-all between celebs, some speculated that the recording could be considered illegal, and that Tay — who issued a cease and desist to Kanye earlier this year, according to TMZ — could sue.

But in a follow-up story, TMZ now says she doesn’t have a case.
Why? Because Kanye wasn’t the only one in the room.

Here’s the problem … in California, if someone records a “confidential communication” and the other party to the conversation doesn’t know it’s being taped, it’s a crime. But “confidential communication” does not include conversations that “may be overheard.” We’ve heard the full tape … and Taylor knew she was overheard. The conversation from Kanye’s end was on speaker phone, and during the call producer Rick Rubin speaks up several times. Members of the crew filming Kanye on the call also speak in the room. There’s no doubt listening to the full tape … Taylor knew she was being overheard. As a result, it’s pretty clear … Kanye didn’t violate the law by recording it.
While the Swift-West feud dates all the way back to Ye’s infamous interruption of Taylor’s 2009 MTV Video Music Awards speech, the latest drama began back in June with Kim K.’s GQ cover story, in which the Keeping Up With The Kardashians star first made the revelation that Taylor Swift knew about the “Famous” lyric all along — and that Kimye had video proof of the call.
“It was funny because [on the call with Kanye, Taylor] said, ‘When I get on the Grammy red carpet, all the media is going to think that I’m so against this, and I’ll just laugh and say, ‘The joke’s on you, guys. I was in on it the whole time,’” Kim said. “And I’m like, wait, but [in] your Grammy speech, you completely dissed my husband just to play the victim again.”
